Welcome to Moto Odyssey LLC ("Moto Odyssey," "we," "us," or "our"). These Terms & Conditions ("Terms") govern your access to and use of our website, the Moto Odyssey App, and all related services, including guided motorcycle tours, Moto Odyssey Rider Confidence Program training, motorcycle events, charity rides, merchandise sales, and rider accounts (collectively, the "Services"). By accessing or using our Services, you agree to these Terms.
1. Eligibility
You must be at least 18 years old to create a rider account, register for a guided tour, or purchase merchandise. Riders under 18 may participate in Moto Odyssey Rider Confidence Program sessions designed for minors only with the consent and supervision of a parent or legal guardian.
2. Rider Accounts
Creating a rider account requires accurate and current information. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Moto Odyssey reserves the right to suspend or terminate accounts that provide false information, violate these Terms, or engage in conduct that endangers other riders.
3. Mobile Application (Moto Odyssey App)
Use of the Moto Odyssey App is subject to these Terms. The app provides features including rider account management, event registration, ride history, and optional GPS ride tracking. Moto Odyssey grants you a limited, non-exclusive, non-transferable license to use the app for personal, non-commercial purposes. You may not reverse-engineer, modify, or redistribute the app.
4. GPS and Location Services
GPS ride tracking is an optional feature that you may enable or disable within the Moto Odyssey App. When enabled, the app collects real-time location data to support route tracking, group coordination, and safety monitoring during rides. Moto Odyssey is not responsible for interruptions in GPS tracking caused by network connectivity, device limitations, or terrain conditions. Riders remain solely responsible for navigation and safe operation of their motorcycle regardless of GPS tracking status.
5. Guided Motorcycle Tours
Guided tours are led by experienced Moto Odyssey ride leaders. Participants must hold a valid motorcycle license appropriate to the jurisdiction of the tour and must operate a motorcycle in safe, roadworthy condition. Moto Odyssey reserves the right to remove any participant from a tour whose conduct or equipment poses a safety risk, without refund. Tour itineraries, routes, and schedules may change due to weather, road conditions, or safety considerations.
6. Moto Odyssey Rider Confidence Program
The Moto Odyssey Rider Confidence Program is designed to develop and improve motorcycle riding skills for riders of varying experience levels. Enrollment requires payment of applicable course fees and completion of any required waivers. Course completion certificates are issued based on instructor assessment and do not guarantee licensing eligibility, which remains subject to applicable state and local requirements.
7. Motorcycle Events and Charity Rides
Moto Odyssey organizes and hosts motorcycle events and charity rides, which may be operated independently or in partnership with third-party organizations and charitable causes. Event registration fees, applicable donation amounts, and event rules will be disclosed at the time of registration. Donations made through charity rides are directed to the designated charitable partner as described in the event listing, and Moto Odyssey may retain a portion of proceeds to cover event administration costs unless otherwise stated.
8. Event Registration
Registration for tours, Moto Odyssey Rider Confidence Program courses, and events is confirmed upon receipt of full payment unless otherwise specified. Registration is subject to availability, and Moto Odyssey reserves the right to decline registration at its discretion. Cancellation and refund terms will be disclosed at the time of registration for each specific tour, course, or event.
9. Merchandise Purchases
All merchandise sold through our website or app is subject to availability. Prices are listed in U.S. dollars and are subject to change without notice. We reserve the right to limit order quantities, refuse orders, and correct pricing errors. Shipping timelines are estimates and are not guaranteed. Returns and exchanges are subject to the return policy posted at the time of purchase.
10. Payment Processing
All payments made through our website and app are processed through secure third-party payment processors. By submitting payment information, you represent that you are authorized to use the payment method provided. Moto Odyssey is not responsible for errors caused by incorrect payment information submitted by the user.
11. Email, SMS, and Push Communications
By creating a rider account or opting in through our website or app, you may receive email communications, SMS text messages, and push notifications related to your account, registrations, and promotional offers. SMS communications are governed by our SMS Terms of Service. You may opt out of promotional communications at any time using the unsubscribe or opt-out method provided in each message or through your account settings.
12. Assumption of Risk
Motorcycling, guided tours, Moto Odyssey Rider Confidence Program training, and motorcycle events involve inherent risks, including but not limited to risk of injury, property damage, and death. By participating in any Moto Odyssey activity, you acknowledge and voluntarily assume these risks. Participants are required to sign a separate liability waiver prior to participating in guided tours, Moto Odyssey Rider Confidence Program courses, events, or charity rides.
13. Acceptable Use
You agree not to:
- Use our Services for any unlawful purpose
- Interfere with or disrupt the operation of our website or mobile application
- Attempt to gain unauthorized access to any Moto Odyssey system or another user's account
- Post or transmit harassing, abusive, or defamatory content through any Moto Odyssey platform
- Use automated systems to scrape or extract data from our website or app
- Misrepresent your identity or affiliation with Moto Odyssey
Violation of this section may result in immediate suspension or termination of your account and access to our Services.
14. Intellectual Property
All content on the Moto Odyssey website and Moto Odyssey App, including logos, graphics, text, course materials, route maps, and software, is the property of Moto Odyssey LLC or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without prior written consent.
15. Account Termination
Moto Odyssey may suspend or terminate your rider account at any time, with or without notice, for violation of these Terms, safety concerns, fraudulent activity, or at our sole discretion. You may request closure of your rider account at any time by contacting customer support. Termination does not entitle you to a refund for prior purchases or registrations, except as required by applicable law.
16. Disclaimers
Our Services, website, and mobile application are provided on an "as is" and "as available" basis. Moto Odyssey makes no warranties, express or implied, regarding the accuracy, reliability, or availability of our Services, including GPS tracking accuracy, route information, or app performance.
17. Limitation of Liability
To the fullest extent permitted by law, Moto Odyssey LLC and its owners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our Services, participation in tours, events, Moto Odyssey Rider Confidence Program courses, or charity rides, or reliance on GPS tracking features. Moto Odyssey's total liability for any claim arising from these Terms shall not exceed the amount you paid for the specific Service giving rise to the claim.
18. Indemnification
You agree to indemnify and hold harmless Moto Odyssey LLC, its owners, employees, and affiliates from any claims, damages, losses, or expenses arising from your violation of these Terms, your participation in any Moto Odyssey activity, or your misuse of our Services.
19. Governing Law
These Terms are governed by the laws of the State of Connecticut, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Connecticut.
20. Changes to These Terms
Moto Odyssey may update these Terms from time to time. Continued use of our Services after changes are posted constitutes acceptance of the revised Terms.
